The Counsellor Midwife Hypnobirthing Courses Terms and Conditions
General
- The Counsellor Midwife (Samantha Phillis) is a midwife, but has no insurance to practice privately as a midwife, therefore, clinical advice on your own current pregnancy and wellbeing cannot be given under any circumstances and you must take queries about your own personal health or pregnancy to your midwife, GP, Obstetrician, or other appropriate health professional
- The Counsellor Midwife treats everyone fairly and equally
Health and Safety
- The Counsellor Midwife always strives to provide a safe environment during sessions, however, The Counsellor Midwife cannot accept responsibility or liability for any loss, damage or injury to any person or property arising out of or resulting from attending a session
- If you, or your birth partner, feel unwell whilst in attendance at the sessions you should immediately seek the advice of your midwife, GP or other appropriate health professional
- It is your responsibility to inform The Counsellor Midwife of any changes to the original information provided on the Booking Form prior to each session
- The Counsellor Midwife cannot accept any responsibility for the loss or damage of any personal possessions during or after sessions

Photographs
- The Counsellor Midwife would prefer that you focus all your attention on the session, however, you may take photographs before or after the session, if you only photograph yourself or those who have consented to be photographed
- Recording video or sound during sessions is strictly prohibited
- Photographs will only be taken of you during sessions by prior arrangement and with your consent
Booking
- The full amount is payable at the time of booking
- Payments are accepted on the website, via Paypal
- The booking form must be completed before attending any session with The Counsellor Midwife, this is done at checkout on the website or by email
- A booking does not constitute the creation of a contract and The Counsellor Midwife reserves the right to decline to process a booking for any reason whatsoever, if the booking is not able to be fulfilled The Counsellor Midwife will issue a full refund
Cancellations, Absences, and Refunds
- You may cancel a session at any time by email or phone
- If you cancel more than 6 weeks before a session then you will receive a full refund, less £25 to cover administration costs
- If you cancel less than 6 weeks before a session then you will only be entitled to a full refund, less £25 to cover administration costs and course materials, in extenuating circumstances, at the discretion of The Counsellor Midwife
- In the unlikely event that The Counsellor Midwife cancels a session then a refund will only be given if a suitable alternative cannot be provided, such as conducting the session online instead of face-to-face or the rescheduling of the session.
- In the unlikely event that The Counsellor Midwife cancels a session during a course then a refund will only be given for the part of the course not yet delivered, and only if a suitable alternative cannot be found, such as conducting the session online instead of face-to-face or the rescheduling of the session.
- There is a minimum number of participants required to run sessions, if for any reason these numbers are not reached then The Counsellor Midwife reserves the right to cancel and a full refund will be given in this situation
- If you miss a session, The Counsellor Midwife may offer attendance another session at a later date, if there is enough availability, however there is no obligation to provide this option
Qualifications and Insurance
- The Counsellor Midwife is fully insured
- The Counsellor Midwife (Samantha Phillis) is a fully qualified and practising NHS midwife and a fully qualified Hypnobirthing practitioner (training through KGH Hypnobirthing).
Personal Data
- The Counsellor Midwife adheres to all data protection policies and legislation
- The personal data you provide to The Counsellor Midwife is used for insurance reasons, to ensure the highest standards of health and safety during classes and to contact you with information about your booking
- The Counsellor Midwife stores your data electronically only
- Your personal data will not be shared with anyone else
Intellectual Property
- The recordings and written material included as part of this course are the sole property of KGH Hypnobirthing and/or The Counsellor Midwife and may not be used or copied other than for the personal use of the participant without obtaining prior written permission from KGH Hypnobirthing and/or The Counsellor Midwife
Disclaimer
- Using Hypnobirthing techniques is not a substitute for the advice or presence during birth or any part of your pregnancy or labour of a qualified medical practitioner, midwife or obstetrician
- It does not represent in fact or otherwise an alternative to appropriate medical care or for professional medical advice in any way shape or form
- The Counsellor Midwife and KGH Hypnobirthing accept no responsibility for the inappropriate use of Hypnobirthing techniques or complications or harm to any third party resulting from the use of Hypnobirthing techniques as a substitute for medical advice
- Hypnobirthing is intended solely as an ‘aid’ to ‘help’ increase the comfort of labour and birth and is not in any way a guarantee or promise of expected, imagined or actual outcome of the labour or birth in any way, shape or form
- Participation in Hypnobirthing classes in any part or in total by any person or third party is undertaken with the understanding by any persons or third party that no litigation or legal action whatsoever will be initiated or that no form of compensation or reimbursement or refund will be claimed or applied for at any time now or in the future against The Counsellor Midwife or KGH Hypnobirthing and its representatives under any circumstances whatsoever
Agreement
- Any booking of a Hypnobirthing course assumes full and informed compliance to, and agreement with, all these terms and conditions of sale
- In the event of a dispute, English law pertains
The Counsellor Midwife Hypnobirthing Courses Covid-19 Policy (March 2022)
• Due to the nature of the pandemic, and the continually changing guidance and legislation, this policy is subject to change with very little notice, you will be notified of any changes to the policy made after a booking by email
• If you are unhappy with any changes to this policy, or in the event of any other Covid-related cancellation, absence, or refund request, please see the ‘Cancellations, Absences, and Refunds’ section of ‘The Counsellor Midwife Hypnobirthing Courses Terms and Conditions’
• The Counsellor Midwife has no specific Covid-related cancellation, absence, or refund request policy
• Clients must bring their own drinks and/or snacks and/or lunch, any snacks provided by The Counsellor Midwife will be individually wrapped
• Hand sanitiser will be available
• Do not attend a session if you have any symptoms of Covid
• Do not attend a session if you have tested positive for Covid and you are still within the self-isolation period
• There is no requirement to touch props if you’d prefer not to
• The venue is Covid-19 secure in line with government guidelines
• Please respect other attendees, there may be people in the room who are more vulnerable or feeling more cautious than you
• The Counsellor Midwife (Samantha Phillis) is fully vaccinated
